General Terms and Conditions

Introduction

With its product "Veegaz", Level5 GmbH ("Veegaz") offers its customers access to a service via HbbTV and/or HTML that allows customers to receive and use movies, film sequences, videos, and other audiovisual content ("Veegaz content") as well as voice services over the internet and internet- or HbbTV-enabled televisions, smartphones, computers, and other devices ("Veegaz-enabled devices"). These terms and conditions ("AGB") govern the use of these services, including all related offers, features, functions, recommendations, visual and technical designs, user interfaces, and menus, as well as all content and software associated with the services.

Registration and Membership

  1. To use Veegaz, registration including age verification is required. For the use of pure audio content ("Veegaz Voice"), registration is sufficient; for all other Veegaz offers, a paid membership is required. By registering, a contract is concluded between you and us, Level5 Media GmbH, Nymphenburgstr. 57, 40625 Düsseldorf. The contract is generally concluded when we confirm your registration or membership. If we provide access to Veegaz content beforehand, the contract is already concluded with the provision of Veegaz content.
  2. The minimum duration of a membership is one month and begins with the operational provision of Veegaz content to you. The membership continues until it is canceled. The contract can be terminated by either party at any time after the minimum contract period with a notice period of six working days to the end of the month.
  3. To use Veegaz, you need internet access and a Veegaz-enabled device. You also need to choose one or more payment methods, i.e., a current, valid, and accepted payment method. The payment method needs to be updated from time to time and may include payments via your account with a third party (e.g., a bank or credit card provider or another financial institution). Unless you cancel your membership before the billing date, you agree that the membership fee for the next billing period will be charged to your payment method (see the "Cancellation" section below).
  4. Veegaz offers different membership subscriptions that vary in terms of duration, content, and prices. Some subscriptions may have conditions and restrictions compared to other subscriptions, which will be disclosed to you during registration or in other notifications. You can view the details of your Veegaz membership by logging into your "Account" information on our website.

Veegaz Voice

  1. Through our service "Veegaz Voice", we offer you thematic audio/voice files (i.e., files that serve the purpose of playing and listening to sounds, speech, music, voices, and noises) as well as telephone discussions between you and our service providers for the exchange of thoughts, small talk, the verbal exchange of erotic fantasies, verbal role-playing games, or other conversations by arrangement between the participants.
  2. The Veegaz Voice service is generally available to you immediately after registration; a membership is not required. You can use specific Veegaz Voice services if you have a pre-purchased credit, comparable to a "prepaid" model. Veegaz Voice allows you to establish and maintain call connections as long as you have a positive credit balance at least sufficient for a call of the minimum length of the smallest billing unit applicable to the respective service. The billing units, billing details, and other payment details for credit top-ups can be found under sections 3.6 and 3.7 below. Additionally, and both organizationally and commercially separate from our paid Veegaz Voice service, telephone connection fees to the local network of the local telecommunications provider may apply, which will be billed directly between the telecommunications provider and you at the respective local rate.

Billing and Cancellation

  1. The membership fee for the Veegaz service will be charged using the payment method you specified. The user/usage purpose will generally appear as "veegaz.com / Düsseldorf" in connection with the designation of your subscription. The payment day, and thus the day on which your payment method is actually charged, corresponds to the respective billing date indicated under your "Account" information. This can mean, for example, that a credit card is charged immediately after entering the credit card details. The duration of the billing period depends on which specific membership subscription you chose during registration. In some cases, your payment date may change. This can happen, for example, if the amount could not be charged to your payment method or if your paid membership started on a day that does not exist in the respective month. Further details can also be found in the "Account" information.
  2. By providing one or more payment methods, you authorize us to charge your account accordingly, even if your primary payment method is declined or no longer available for payment. You remain obligated to pay outstanding amounts if any of the payment methods you provided fail (e.g., because the credit card has expired, there are insufficient funds, or due to incorrect information). Access to our service may be suspended until we receive the due payments. Please note that third parties may charge fees for certain payment methods (e.g., transaction fees for foreign use, currency conversion fees, etc.), and local taxes may vary depending on the payment method. You are responsible for such fees and taxes; please inquire with your payment method provider in case of doubt. You are also responsible for keeping your payment methods up to date. Veegaz is entitled (but not obligated) to update your payment methods with data we receive from payment service providers. Following each update, you authorize us to continue charging the relevant payment methods.
  3. You can cancel your Veegaz membership at any time and continue to use the Veegaz service until the end of your billing period. Payments are non-refundable, and we do not provide refunds or credits for partially used subscription periods or unused Veegaz content. To cancel your membership, please go to the "Account" information and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of the current billing period. The time at which your account will be closed can be seen in the "Account" information. If you used a third-party payment method when registering for Veegaz and want to cancel your Veegaz membership, you may need to do so through the respective third party. This may require you to access your account with the respective third party and turn off automatic renewals or unsubscribe from the Veegaz service through that third party.
  4. Our subscription service and prices may change from time to time. Changes to prices and your subscription service will not take effect until 30 days after notification to you.
  5. If you want to use Veegaz Voice, you need credit. The billing unit for credits at Veegaz Voice is called "Coins". One Coin costs 1 cent. 100 Coins correspond to 1 EUR. Coins can only be purchased in whole amounts; there are no fractions of a Coin. You can purchase Coins at any time using the payment method you provided – and additionally via instant transfer or Paysafecard – in your customer account. Each 120 Coins entitle you to participate in 1 minute of Veegaz Voice. For one minute of conversation, you pay the equivalent of 120 Coins = 1 EUR. If the credit is used up, you can either top up your credit or no longer participate in Veegaz Voice. Coins are valid indefinitely but cannot be exchanged back into EUR. The stated prices include VAT (value-added tax) at the legally prescribed rate.
  6. The billing for Veegaz Voice consists of time units. Each started minute counts as a full time unit. For connections under one minute, a connection duration of one minute is assumed. The prerequisite for using the Veegaz Voice service is that you have sufficient credit before establishing the connection, i.e., at least 120 Coins. The billable service duration generally begins with the acceptance of the call by the respective Veegaz Voice service provider. The connection time ends when the connection is terminated.

Veegaz Service

  1. To acquire a membership with Veegaz and use the services, you must be at least 18 years old or have reached the corresponding legal age of majority in your region or country. Minors are excluded from using Veegaz content.
  2. The membership and Veegaz content you can view through the service are for your personal and non-commercial use only and may not be shared with other people. During your Veegaz membership, we grant you a limited, non-exclusive, and non-transferable right to access the Veegaz service and view Veegaz content. Apart from that, no rights, titles, or claims are transferred to you. You agree not to use the service for public performances.
  3. You can generally view the Veegaz content in the country where you created your account and only in geographic regions where we offer our service and have licensed the Veegaz content. The geographically available Veegaz content may change from time to time and vary by region.
  4. The Veegaz service (including the website, user interfaces, advertising functions, and content availability) and the Veegaz content are regularly updated and tested. Veegaz reserves the right to change the booked services and products if the change is required due to legal or regulatory requirements, ensures the interoperability of the networks, or serves to adapt to technical progress - as long as this does not result in restrictions for our customers or an alternative service is available that includes comparable performance. Veegaz is also entitled to temporarily interrupt, restrict, or discontinue the service if this is necessary for reasons of public safety, due to official or legal requirements, to ensure network operation security, to maintain network integrity, due to data protection, or to carry out operational or technical work. This also applies to services from third parties that Veegaz uses to fulfill its obligations. If a disruption or interruption for which Veegaz is responsible lasts longer than 24 hours, the customer is entitled to a proportional reduction of the monthly subscription price.
  5. Veegaz content is copyrighted. You agree not to record, archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, present yourself as a provider of Veegaz content, or use content and information provided by Veegaz outside of these AGB. You also agree not to circumvent, remove, alter, deactivate, reduce, or prevent copy protection; not to use robots, spiders, web scraping, or other automated processes to access the Veegaz service; not to decompile, reverse engineer, or disassemble any software or other products or processes accessible through the Veegaz service; not to insert codes or other products or manipulate the Veegaz service in any other way; not to use data mining, data collection, or other extraction methods; and - for services at fixed locations - not to establish a second connection using Point to Point Protocol over Ethernet (PPPoE) or to use the services for permanent or cyclical networking or connection of locations or telecommunications systems or for machine-to-machine connections. Furthermore, you agree not to perform manipulations in such a way as to cause disruption, suspension, or restriction of the function of computer software/hardware or telecommunications equipment in connection with the Veegaz service. This also applies to any software viruses or other codes, files, and programs. If you violate these AGB or use the service in an illegal, abusive, or fraudulent manner, we are entitled, without prejudice to our possible right to compensation, to terminate or restrict your use of our service.
  6. The display quality of Veegaz content may vary depending on the device and internet speed and is also dependent on other factors such as your location, building conditions, and other factors. Not all Veegaz content is available in all formats (such as HD, Ultra-HD, and HDR), and not all subscriptions allow the reception of Veegaz content in all formats. The minimum speed for viewing videos in standard resolution is 2 Mbps. However, a faster connection is recommended for better image quality. For receiving Ultra-HD and HDR content (with a resolution of at least 1080p), a download speed of at least 80 Mbps is recommended. You are responsible for all fees associated with internet access. Please contact your internet provider for more information on possible data usage fees.
  7. Our software is developed by or for Veegaz and is designed for playing Veegaz content on Veegaz-compatible devices. This software may vary by device and media and may have different functions and features. You acknowledge that using the Veegaz service may require third-party software, for which third-party licenses are required. You agree to receive automatically updated versions of Veegaz and associated third-party software.
  8. The user who created the Veegaz account and whose payment method is charged with the membership fees ("account holder") has access to and control over the Veegaz account and Veegaz-compatible devices used to access the Veegaz service. He/she is thus responsible for any activities associated with the Veegaz account. To maintain control of the account and prevent unauthorized access, the account holder should always have control over the Veegaz-compatible devices used to access the service and not share passwords or account information with third parties. To protect you, Veegaz, or our partners from identity theft or other fraudulent activities, Veegaz is entitled to terminate your membership or temporarily suspend your account.
  9. Veegaz regularly offers new content. This means that we regularly but also irregularly include new movies, videos, and other offers. To keep users up to date, we send automated emails to the address you provided. This is, of course, only if you have completed the age verification and have not objected to this service. These emails regularly include instructions on how to unsubscribe from this service. Usually, a link with the text "Unsubscribe" is included. Alternatively, you can contact our support via email. We will then manually unsubscribe you from this service in a timely manner.

Miscellaneous

  1. These AGB are subject to German law. They do not limit any consumer protection rights that you are entitled to under mandatory laws.
  2. For more information about our service and its features or if you need support with your account, please visit the Veegaz Help Center on our website.
  3. Should any provision of these AGB be found invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected.
  4. These general terms and conditions apply to all business relationships between Veegaz and the respective customer. The version valid at the time of contract conclusion is decisive. Changes and adjustments to the AGB remain reserved. The current version is available on our website. Veegaz may change these AGB from time to time. We will inform you at least 30 days in advance before such changes take effect for you.
  5. Electronic communications. Account-related information (e.g., payment authorizations, invoices, password or payment method changes, confirmation, and other notifications) will be sent exclusively in electronic form, such as emails to the email address you provided during registration.
  6. It may be that you do not like everything you see on Veegaz. For content that you consider inappropriate or believe to violate our terms of use, we invite our Veegaz community to use our reporting function.
